OFFICIAL SWEEPSTAKES RULES
1. NO PURCHASE IS NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT IMPROVE CHANCE OF WINNING.
2. Sporty's 2009 Synthetic Vision Skyhawk Sweepstakes is open to all individuals; however, to be eligible to win a prize an individual, or the individual's spouse, son, daughter, mother, or father, must be certificated or licensed as a Student, Sport, Recreational, Private, Commercial, or Airline Transport Pilot on May 16, 2009. A medical certificate is not necessary. To enter Sporty's 2009 Synthetic Vision Skyhawk Sweepstakes, simply place an order with, or request a catalog from, Sporty's Pilot Shop between 5:00 p.m. EDT September 5, 2008, and 5:00 p.m. EDT May 8, 2009 (the "sweepstakes period"). Each time you enter you increase your chances of winning, except additional entries will not result from multiple requests for catalogs. Should an order be placed by one individual and sent to another individual, the person placing the order shall be declared the winner or potential winner. Sporty's 2009 Synthetic Vision Skyhawk Sweepstakes is not open to the employees of Sportsman's Market, Inc., its affiliates, or members of their families (including spouse, children, parents, brothers, and sisters) living in the same household as the employee. Subject to all state and Federal laws. Void where prohibited by law and in certain states where sweepstakes registration is required. These official sweepstakes rules are subject to interpretation by the Sponsor.
3. One Grand Prize winner will receive a 2008 Synthetic Vision equipped Cessna 172S Skyhawk SP, delivered at Clermont County Airport, Batavia, Ohio. THE APPROXIMATE RETAIL VALUE ("ARV") OF THE GRAND PRIZE IS $250,000.
4. The potential Grand Prize Winner will be determined by a random drawing conducted on or about May 16, 2009 by John D. Reis, a Certified Public Accountant (or other independent CPA designated by the sponsor), whose decision will be final. THE ODDS OF WINNING WILL DEPEND UPON THE NUMBER OF ENTRIES RECEIVED.
5. The potential Grand Prize Winner will be notified by mail. Within five days of notification the Grand Prize Winner must return a photocopy of his/her pilot certificate/license and an advertising publicity/liability release signed by the Grand Prize Winner (or the Grand Prize Winner's parent or legal guardian if Grand Prize Winner is a minor). If a Grand Prize Winner or potential Grand Prize Winner declines to accept the prize, or in the event notification cannot be accomplished within ten days of the first notification attempt, the Grand Prize Winner or potential Grand Prize Winner may be disqualified and the Sponsor will select an alternate Grand Prize Winner. The name and a photograph of the Grand Prize Winner will be published in at least one future issue of Sporty's Pilot Shop catalog, and will appear on the Sponsor's website, www.sportys.com. Winner's name and hometown (not street address) may be listed in Sponsor's publications, on its website, and in its releases to the press. All winners are responsible for applicable local, state, or Federal taxes.
6. All entries become property of the Sponsor, and no entries will be acknowledged. All entries have an equal chance of winning. By entering each entrant (and entrant's parent/legal guardian if entrant is a minor) agrees: (a) to be bound by these Official Sweepstakes Rules; (b) that any claims and causes of action arising out of or in connection with the Sporty's 2009 Synthetic Vision Skyhawk Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a Federal or state court within the State of Ohio; (c) that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sporty's 2009 Synthetic Vision Skyhawk Sweepstakes, but in no event shall such damages include attorneys' fees; and (d) that under no circumstances will an entrant (and entrant's parent/legal guardian if entrant is a minor) be permitted to obtain awards for, and each entrant (and entrant's parent/legal guardian if entrant is a minor) hereby waives all rights to, punitive, incidental, consequential, or other damages other than actual out-of-pocket expenses. No entrant (or entrant's parent/legal guardian if entrant is a minor) shall claim or receive any damages subject to being multiplied or otherwise increased. All issues and questions concerning these Official Sweepstakes Rules, or the rights and obligations of entrants or the Sponsor in connection with the Sporty's 2009 Synthetic Vision Skyhawk Sweepstakes, shall be governed by and construed in accordance with the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Ohio or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Ohio. In no event will more than one Grand Prize be awarded.
7. NO PURCHASE IS NECESSARY. To enter Sporty's 2009 Synthetic Vision Skyhawk Sweepstakes without ordering from Sporty's Pilot Shop send a self-addressed, stamped business size (#10) envelope to: Sporty's 2009 Synthetic Vision Skyhawk Sweepstakes, Box 44349, Cincinnati, Ohio 45244. Official alternative entry materials will be sent. Only valid official alternate entry forms will be accepted and each must be mailed separately. No reproductions will be accepted. All correspondence, including addressing, must be in entrant's personal handwriting. No machined and/or electronic correspondence shall be accepted. No mass/bulk mailing of any kind shall be accepted. Send completed alternate entry forms to: Sporty's 2009 Synthetic Vision Skyhawk Sweepstakes, Box 44327, Cincinnati, Ohio 45244. All entries must be received by 10:00 a.m. EDT May 8, 2009. No responsibility will be assumed for lost, misdirected, or late mail. The Sponsor reserves the right to amend and interpret these rules.
